Thank you for choosing Kemz’ Captures for your photography needs. These Terms and Conditions outline the rights, responsibilities, and expectations for both clients and Kemz’ Captures. By booking our services, you agree to abide by these terms, including policies on payments, deposits, cancellations, privacy, image ownership, and delivery. Please read them carefully to understand how we operate and how we protect both your experience and our creative work.
Kemz’ Captures – Terms & Conditions

By booking or using services provided by Kemz’ Captures, the client agrees to the following Terms & Conditions.
1. Service Tiers & Classification
Kemz’ Captures offers two service tiers. Classification is determined by group size and the nature of the booking.
1.1 Casual Photos (Private Level)
• Individuals, couples, families, or small groups
• 1–6 people
• Includes families with children
• Private, non-commercial use only

Family sessions involving six (6) or fewer total people are classified as Casual Photos, regardless of age.
1.2 Social Gatherings (Private Level)
• Small events and extended groups
• 7 or more people
• Includes parties, reunions, and private celebrations
• Private, non-commercial use only

Family sessions involving seven (7) or more total people are classified as Social Gatherings.

2. Booking, Deposits & Payment
• A 50% non-refundable deposit is required at or before the scheduled session start time.
• The session will not begin until the required deposit has been received.
• The deposit secures the booking date and confirms the client’s commitment to the session.
• The remaining balance must be paid upon completion of the session prior to final image delivery.
• A 12% government tax will be applied to all services in accordance with local regulations and is payable in addition to the listed service prices.
• Kemz’ Captures operates primarily within Providenciales. Sessions on other islands must be requested in advance and are subject to availability, travel coordination, and booking confirmation.

3. Payment Confirmation
• Confirmation of payment and booking will be provided upon receipt of payment.
• Confirmation will be issued via email or text message.

4. Client Readiness, Punctuality & Waiting Time
• Sessions begin at the scheduled time.
• A maximum grace period of 20 minutes is provided for delays, including lateness, transportation issues, or unforeseen circumstances.
• Any time lost beyond this grace period remains the responsibility of the client.
• If clients arrive within the grace period, the session will proceed as scheduled and will still conclude at the originally scheduled end time.
• If the required number of participants has not arrived within the 20-minute grace period, Kemz’ Captures reserves the right to cancel or terminate the session.
• In such cases, the deposit remains payable and is retained as compensation for the reserved time and booking commitment.

5. Creative Style & Artistic Direction
• Clients acknowledge familiarity with Kemz’ Captures’ creative and editing style.
• Artistic interpretation, composition, and editing choices are subjective.
• Dislike of creative style does not constitute grounds for refunds or re-shoots.

6. Image Ownership & Copyright
• All images captured by Kemz’ Captures remain the exclusive intellectual property of Kemz’ Captures.
• Clients purchase the service and licensed usage, not ownership of the images.
• Full ownership of images is never transferred under any circumstances.

7. Usage Rights & Limitations
• Images provided under Casual or Social tiers are licensed for personal use only.

Commercial use of images is prohibited without prior written agreement and applicable licensing fees.

8. Portfolio, Promotion & Privacy Opt-Out
• Kemz’ Captures retains the right to use selected images for portfolio, marketing, and promotional purposes.
• Clients may opt out of public use by paying the applicable privacy fee.
• Privacy fees apply per service tier as disclosed at booking.
• Privacy opt-out limits public display only and does not affect ownership rights.

9. Image Delivery & Archival
• All images are delivered digitally via secure download link.
• No physical products or prints are provided.
• Upon final delivery, responsibility for image storage transfers to the client.
• Kemz’ Captures is not responsible or liable for long-term storage or re-delivery of past sessions.
• Requests to retrieve previously delivered images may be made but are not guaranteed.
• Image quantities vary based on session flow, participation, and shooting conditions. Kemz’ Captures delivers all successful, quality images rather than a fixed photo count.

10. Turnaround Time & Rapid Delivery
• Standard delivery timelines are provided at booking.
• Rapid Delivery (within 48 hours) is available for eligible services at an additional fee.
• Delivery timelines apply after full payment is received.

11. Client Responsibility, Safety & Conduct
• Clients are responsible for the behavior of all participants; any adult present and booked for the session is responsible for minors.
• Kemz’ Captures is not responsible for any injuries, lost items, or incidents involving participants.
• Kemz’ Captures reserves the right to pause or terminate a session if conditions become unsafe, hostile, or unreasonably disruptive.
• No refunds will be issued in such circumstances.

12. Force Majeure
• Kemz’ Captures is not liable for failure to perform services due to events beyond reasonable control, including natural disasters, severe weather, government restrictions, or emergencies.
13. Cancellation & Emergency Policy
• Cancellations must be communicated as soon as possible.
• In the event of an emergency, clients may request to reschedule their session. Approval is at the discretion of Kemz’ Captures.
• Cancellations made less than 24 hours before the scheduled session may result in forfeiture of the deposit.
• In cases of genuine emergencies, Kemz’ Captures may allow a one-time reschedule without penalty.

14. Governing Law
• These Terms & Conditions are governed by the laws of the Turks and Caicos Islands.
• Any disputes shall fall under the jurisdiction of the courts of the Turks and Caicos Islands.

• Booking a session or using Kemz’ Captures’ services constitutes full acceptance of these Terms & Conditions.
